Kahoots, Inc. and its affiliates (“Kahoots,” “we,” “our,” “us”) respect the privacy of our customers. This Privacy Policy explains what information we collect from individuals who visit our websites where this Privacy Policy is posted (each, a “Site”) or who connect with us offline, such as by telephone or in our stores (together with the Sites, the “Services”), and how we store, use, disclose, and protect that information. By using or accessing our Services, you agree to the collection, storage, use, and disclosure of your information as described in this Privacy Policy.

What Information We Collect

Information You Give Us

We collect and maintain information you provide through our Services, including your name, shipping address, billing address, payment information, telephone number(s), email address(es), and purchase, return, and exchange history. For example: when you set up an account or make a purchase, you provide contact and payment information needed to complete the transaction; when you enter contests, sweepstakes, or promotions, you may be asked for information needed to fulfill the promotion; when you post reviews, questions, or other content in public areas of our Services, that content is available to us and to other visitors; and when you contact our customer service team, we collect the information you choose to share. We also collect information about your pet(s), such as name, breed, gender, birthdate, weight, veterinary information, and photos.

Information Automatically Collected

We use technology to automatically collect information about you when you visit our Services or view our advertisements. See Cookies and Interest-Based Advertising below. This information helps our Services work correctly and supports our marketing and analytics efforts. It includes, but is not limited to, device type, browser information, operating system, IP address, mobile device identifiers, general geolocation, the date, time, and length of your visit, the referring website, and the pages you view and actions you take on our Services.

Information Collected from Other Sources

We receive information about you from other sources to help us correct or supplement our records, improve the personalization of our Services, and prevent or detect fraud. We use this information consistent with this Privacy Policy.

Information Collected Through Social Media Services

If you interact with us through a social media platform (e.g., Facebook, Instagram, YouTube), you give us permission to access, store, and use the information you permit that platform to share with us, in accordance with your privacy settings on that platform. Social media providers may also collect information from you when you use their features with our Services. We are not responsible for the privacy practices of social media platforms, and we encourage you to review and adjust your privacy settings on those platforms.

We use the information we collect for our business purposes, including to:

  • Respond to your questions and requests: fulfilling orders, arranging delivery, administering promotions, and responding to reviews and feedback.
  • Communicate about your account: notifying you about changes to this Privacy Policy, our Terms of Service, our Services, order issues, or product recalls.

  • Understand trends and customer interests: including linking your activity across the devices you use so we can provide a consistent experience.

Affiliates

We may share your information with our affiliates for business, operational, promotional, marketing, or other purposes consistent with this Privacy Policy.

Third-Party Service Providers

We may disclose information to contractors and partners who perform services on our behalf, such as fulfilling orders, delivering packages, sending mail and email, analyzing data, providing marketing research and assistance, processing payments, and providing customer service. These providers are restricted from using information that identifies you in any way other than to provide services for us.

Advertising Partners

We work with third-party advertising partners to deliver ads that are relevant to your interests. With your applicable cookie consent, we may share identifiers such as your email address (in hashed form where supported), device and online identifiers, and information about your activity on our Site with these partners to build advertising audiences and measure ad performance. Under some state privacy laws, these disclosures may be considered a “sale” of personal information or “sharing” for targeted advertising. Business Transfer

We may disclose, transfer, or assign information about you as part of a merger, acquisition, or other sale or transfer of any of the assets or business of Kahoots. In the unlikely event of bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, your data may be transferred to a successor or purchaser of our assets. In such transactions, customer information generally is one of the transferred business assets but remains subject to the promises made in any pre-existing privacy policy.

Protection of Kahoots and Others

We may disclose information to comply with the law, regulations, governmental requests, court orders, subpoenas, and other legal process, or as needed to (i) enforce the terms of use of our Services, (ii) detect, prevent, or address fraud, security, or technical issues, (iii) protect against harm to our Services, or (iv) protect the rights, property, or safety of Kahoots, our users, or others.

Tracking Tools We Use

We and our service providers collect information about users over time and across different websites and devices using tracking tools including cookies, web beacons, pixels, device identifiers, and similar technologies (collectively, “cookies”). We use cookies to:

  • Authenticate your account and remember your login if you are a registered account holder;
  • Monitor performance of our Services;
  • Understand how you interact with our content;
  • Personalize your experience on our Sites and social media;
  • Make product recommendations and show you advertising we think you will find relevant, on our Services and elsewhere;

Consent Management

Where required by applicable law, non-essential cookies are only set after you give consent through the cookie banner on our Site. Interest-Based Advertising

We and our advertising partners use cookies to learn what ads you see, what ads you click, and other actions you take on our Sites and other sites. This allows us to show you more useful and relevant ads on both Kahoots-owned sites and unaffiliated sites. Interest-based ads (also called personalized or targeted ads) are displayed to you based on information from activities such as purchasing on our Sites, visiting sites that contain our content or ads, or interacting with our tools. In providing interest-based ads, we follow the Self-Regulatory Principles for Online Behavioral Advertising developed by the Digital Advertising Alliance (DAA).

Advertisers or ad companies working on their behalf sometimes use technology to serve the ads that appear on our Sites directly to your browser, and automatically receive your IP address when this happens. They may also use cookies to measure the effectiveness of their ads and to personalize ad content. We do not control the cookies or other technologies that advertisers and third-party sites use, and their information practices are not covered by this Privacy Policy. Identity Resolution and Associated Email

When you visit or use our Site and have consented to marketing or analytics cookies, we may use pixels, cookies, or other tracking technologies, through our third-party vendors, to associate your usage of our Site with an associated email address. Where applicable, we may contact you at that associated email address. We do not enable this association for visitors who have not granted the applicable cookie consent. Advertising Preferences and Opt-Out

You have several ways to control interest-based advertising and related data sharing:

  • Do Not Sell or Share: Opt out of the sale or sharing of your personal information for targeted advertising on our Do Not Sell My Data page.
  • Global Privacy Control: We honor the Global Privacy Control (GPC) browser signal as an opt-out of sale and sharing where required by law.
  • Identity resolution: Opt out of our identity resolution vendor at https://customers.ai/opt-out.
  • Industry opt-outs: Opt out of interest-based advertising from participating companies at optout.aboutads.info (DAA) and optout.networkadvertising.org (NAI).

Opting out does not mean you will stop seeing ads; it means the ads you see will be less tailored to your interests.

Text Message (SMS) Marketing

If you opt in to our text message program, including by entering your phone number at checkout and initiating a purchase, you agree that we may send you text notifications (including order updates and abandoned cart reminders) and text marketing offers. Message frequency may vary, and message and data rates may apply. We will send you a message confirming your enrollment. You can unsubscribe at any time by replying STOP, and you can reply HELP for assistance. Wireless carriers are not liable for delayed or undelivered messages.

We use the information you provide through the text program only to send your messages and respond to you, including sharing it with platform providers, phone carriers, and other vendors who assist in delivering messages. We do not sell, rent, loan, trade, lease, or otherwise transfer for profit any phone numbers or customer information collected through the text program to any third party, except as necessary to comply with law, regulation, or governmental request, to avoid liability, or to protect our rights or property.

Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no information system can be 100% secure, so we cannot guarantee the absolute security of your information.

Data Retention

We retain your data for as long as we believe there is a business, legal, or security reason for doing so, even if you are no longer an active customer.

Information from Children

Our Services are not directed at children, and we have no intention of collecting personal information from anyone under 13. If we become aware that information from a child under 13 has been collected without the consent of the child’s parent or guardian, we will use all reasonable efforts to delete it.

Third-Party Websites

Our Services may contain links to websites we believe offer useful information. This Privacy Policy does not apply to those websites, and we are not responsible for their privacy practices. We suggest reviewing the privacy policies of any third-party site you visit.

How to Update Your Information

You may correct or update information collected about you by editing your information in your online account, or by contacting us at customerservice@kahootspet.com. Following receipt of your request, we will take reasonable steps to update or correct your information.

California Privacy Rights

This section applies to California residents and supplements the rest of this Privacy Policy.

Categories of Personal Information

In the last 12 months, we have collected the following categories of personal information as described in this Privacy Policy: identifiers (such as name, email address, phone number, IP address); customer records (such as billing and shipping address and payment information); commercial information (such as purchase history); internet or other electronic network activity (such as browsing and interaction data on our Site); general geolocation data; and inferences drawn from the above (such as product preferences). We collect this information from the sources, and use it for the purposes, described above.

We disclose these categories to service providers for business purposes. We may sell or share identifiers and internet activity information with advertising partners for targeted advertising, as described in the Advertising Partners and Cookies and Interest-Based Advertising sections. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your Rights

Subject to certain exceptions, California residents have the right to:

  • Know and access the personal information we have collected about you;
  • Delete personal information we have collected from you;
  • Correct inaccurate personal information;
  • Opt out of the sale or sharing of your personal information for targeted advertising;

How to Exercise Your Rights

You can submit an access, correction, or deletion request through our Data Request page, by emailing customerservice@kahootspet.com, or by calling (760) 239-3381. To opt out of sale or sharing, visit our Do Not Sell My Data page or enable the Global Privacy Control in your browser. We will verify your request using information associated with your account, such as your email address. You may use an authorized agent to submit a request on your behalf; we may require proof of the agent’s authority and verification of your identity.

Shine the Light

Section 1798.83 of the California Civil Code permits California residents with whom we have an established business relationship to request certain information about the types of personal information we have shared with third parties for their direct marketing purposes during the preceding calendar year. You may make one request each year by emailing customerservice@kahootspet.com.

Other State Privacy Rights

Residents of certain other states (including Virginia, Colorado, Connecticut, Texas, Oregon, Montana, and others) may have similar rights to access, correct, delete, and obtain a copy of their personal information, and to opt out of targeted advertising. You may exercise these rights using the methods described in How to Exercise Your Rights above. If we decline to take action on your request, you may appeal by contacting us at customerservice@kahootspet.com with the subject line “Privacy Appeal.”

Changes to This Policy

We reserve the right, at our discretion, to modify our privacy practices and update this Privacy Policy at any time. We will post the updated policy on this page with a revised “Last updated” date.

Governing Law

By choosing to visit our Services, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of California, without reference to its choice of law principles, and will be subject to the dispute resolution provisions in the Terms of Service applicable to our Services. You also agree to abide by any limitation on damages contained in our Terms of Service.
